The Supreme Court is currently considering Students for Fair Admissions v. UNC, and may decide to overturn Grutter and Fisher, which permit some limited consideration of race in admissions to public schools.
Are there are circumstances in which race-based classifications by the government are permitted under the Constitution?
In the context of public education, does it matter whether the particular race-based classification at issue is being made in the service of a laudable end like racial diversity, as opposed to an invidious end like racial discrimination?
